Master Inspector Association of the Philippines Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services, website, membership programs, events, training, resources, and any associated platforms provided by the Master Inspector Association of the Philippines (“MIAP,” “we,” “us,” or “our”).

By accessing or using any MIAP services, registering as a member, applying for certification (e.g., Registered Master Inspector™), attending events, downloading resources, or submitting information, you agree to be bound by these Terms. If you do not agree, you must not use our services.

 

1. Definitions

Member — Any individual or entity approved for membership in MIAP, including applicants for Registered Master Inspector™ (RMI™) status.

Services — Include membership, certification, training, events, standards of practice, networking, website access, reports, newsletters, and related professional resources.

User — Any person or entity accessing or using MIAP Services, whether as a member, client, visitor, or otherwise.

 

2. Eligibility and Membership

You must be at least 18 years old and legally capable of entering into binding contracts.

Membership is subject to MIAP’s approval based on qualification criteria, including experience, licensing (e.g., Professional Regulation Commission requirements where applicable), and adherence to our Standards of Practice and Code of Ethics.

Membership is non-transferable. Only individuals in good standing may use member benefits, logos, or designations (e.g., RMI™).

MIAP reserves the right to reject, suspend, or terminate any membership application or existing membership for violation of these Terms, the Code of Ethics, Standards of Practice, or applicable laws.

 

3. Use of Services

You agree to use MIAP Services only for lawful purposes and in compliance with these Terms, our Standards of Practice, Code of Ethics, Privacy Policy, and all applicable Philippine laws, including the Data Privacy Act of 2012 (Republic Act No. 10173), the Revised Corporation Code, and professional regulations.

Prohibited activities include:

Misrepresenting your qualifications or MIAP affiliation.

Using MIAP materials, logos, or designations without authorization or after membership termination.

Interfering with the operation of our website or services.

Engaging in conduct that damages MIAP’s reputation or violates inspection industry standards.

Sharing member-only resources with non-members without permission.

 

4. Intellectual Property

All content on MIAP platforms, including Standards of Practice, training materials, reports templates, logos, trademarks, and designations (e.g., “Master Inspector Association of the Philippines,” “Registered Master Inspector™”), is owned by or licensed to MIAP and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use MIAP materials solely for your personal or professional inspection practice while in good standing. You may not reproduce, distribute, modify, or commercially exploit such materials without prior written consent.

 

5. Fees, Payments, and Refunds

Membership dues, certification fees, event fees, and other charges are non-refundable unless otherwise stated in specific program terms.

All payments must be made in Philippine Pesos (PHP) or as specified.

MIAP may change fees upon reasonable notice. Continued use after a fee change constitutes acceptance.

Late payments may result in suspension of membership benefits.

 

6. Inspection Services and Reports (for Members)

Members providing home or building inspection services under MIAP affiliation must:

Adhere strictly to MIAP’s Standards of Practice and Code of Ethics.

Clearly disclose the scope, limitations, and exclusions of each inspection to clients.

Not represent MIAP inspections as code compliance, exhaustive, or warranty evaluations.

Maintain appropriate professional liability insurance where required by law or best practice.

MIAP does not perform inspections itself and bears no responsibility for any inspection conducted by individual members.

 

7. Limitation of Liability and Disclaimers

To the fullest extent permitted by law:

MIAP Services are provided “as is” without warranties of any kind.

MIAP does not guarantee the accuracy, completeness, or reliability of any standards, training, or resources provided.

MIAP shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Services, membership, or any inspection performed by a member.

Our total liability shall not exceed the amount you paid to MIAP in the twelve (12) months preceding the claim.

Members are independently responsible for their own professional conduct, insurance, and compliance with all licensing and regulatory requirements.

 

8. Termination

MIAP may suspend or terminate your access to Services or membership at any time, with or without notice, for breach of these Terms or other policies.

Upon termination:

Your right to use member benefits and MIAP intellectual property ceases immediately.

You must cease using any MIAP designations or materials.

Outstanding fees remain payable.

You may terminate your membership by providing written notice, subject to any notice periods or outstanding obligations in our membership agreement.

 

9. Indemnification

You agree to indemnify, defend, and hold harmless MIAP, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

Your use of the Services.

Your violation of these Terms or any law.

Any inspection, report, or professional service you provide.

 

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection, use, and processing of your personal information as described therein, in compliance with the Data Privacy Act of 2012.

 

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of [insert appropriate city, e.g., Pasig City or Manila], Philippines.

Before initiating legal action, parties agree to attempt good-faith resolution through mediation.

 

12. Changes to These Terms

MIAP may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new effective date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.

 

13. Entire Agreement and Severability

These Terms, together with the Privacy Policy, Standards of Practice, and Code of Ethics, constitute the entire agreement between you and MIAP regarding the Services.

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By using MIAP Services, you acknowledge that you have read, understood, and agree to these Terms of Service.

 

This document is a living agreement and may be reviewed or amended as needed to reflect changes in laws, industry standards, or MIAP operations. Members are encouraged to review it periodically.

 

Adopted by the Master Inspector Association of the Philippines in compliance with Philippine laws, including the Data Privacy Act of 2012 and the Revised Corporation Code.
